If you have a child under the age of 14: After providing proof of personal identity, through the Government Customer Service the legal representative can submit the application for registration of legal representation. Presentation of the document proving legal representation rights is necessary for this purpose. 

For the procedure in the Government Customer Service, it is not necessary for both parents to appear, as they may give authorisation to each other for the procedure. Therefore, the parent present may request registration of his/her own right of representation and of the other party as an authorised person by the presentation of the appropriate instruments proving authorisation.

NECESSARY DOCUMENTS AND INSTRUMENTS:

  • Application for registration of legal right of representation within the EESZT

  • In relation to spouses, the birth certificate of the child is necessary for proving authorisation.

  • In case of a lawsuit filed for exercising custody or for divorce, the court judgment handed down for exercising custody is to be attached.

  • If the parties entered into an agreement for resolving the exercise of custody, it is necessary to present the approval decision of the court. 

  • The court decision restoring parental right of custody needs to be attached if the right of custody revoked earlier is restored.

If you have legal representation rights recorded in the EESZT, you can access certain health data of your child stored in the EESZT through your Residential Portal and can also make a digital self-determination statement on their behalf. You can do this by selecting your child’s TAJ number after logging into the interface.”Note:

  • TAJ is the abbreviation for “Társadalombiztosítási Azonosító Jel,” which is a social insurance identification number in Hungary

  • Legal representation means the following: Authorized persons can request the recording of legal representation rights in the EESZT at the Government Window after personal identification, by submitting an application for the recording of legal representation and simultaneously presenting a document proving legal representation rights. According to current Hungarian laws, the exercise of parental supervisory rights and guardianship as legal representatives is possible until the represented person reaches the age of 18. The recording of a guardian as a legal representative in the EESZT can be fixed for a maximum of 5 years in the case of partial incapacity, and for a maximum of 10 years in the case of full incapacity, starting from the date when the court decision on guardianship becomes final. The result of the mandatory review procedure for guardianship must be reported within 8 days from the date when the judgment becomes final.”

  • “Government Window” refers to a government service point where various administrative tasks can be carried out.
